Poopmaster Terms of Service
TL;DR
You pay, you get the service. You don’t pay, the service will be cancelled.
The Deal
Poopmaster Pro is a subscription service. While all of your data is stored locally on your device, ongoing development and future features take time and energy to develop, I thought that having a minimal amount as a subscription would be a fair tradeoff between people it helps and maintaining my ability to keep it running.
The price is $0.49 (in the US, but roughly the same value in other countries) a month after an initial 30 day free trial period. I think that price is excessively fair to anyone who wants to use the software and is absolutely no risk to try it beforehand. However, you are responsible for cancelling the subscription prior to the first payment. This is handled by Apple and you should refer to Apple’s subscription terms to get details on that. You can manage your subscription on Apple’s billing account management page. If you cancel service, the app should continue to allow you to use it until your remaining time has finished, at which point the app will prompt you to renew your subscription.
Disclaimer
To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to Poopmaster Pro, subscribing to Poopmaster Pro, or use in general (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:
- limit or exclude our or your liability for death or personal injury resulting from negligence;
- limit or exclude our or your liability for fraud or fraudulent misrepresentation;
- limit any of our or your liabilities in any way that is not permitted under applicable law; or
- exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty. To the extent that the Poopmaster Pro and related services, we will not be liable for any loss or damage of any nature.
Caveats
While this is by no means supported, if you find a method by which you are able to disable payment, yet retain functionality of the app, I will not pursure you at all. This decision will be between you and your conscience, if you truly believe you can’t afford the $0.49 a month, yet need the functionality of the app. This would technically be breaking the terms of service, but like I said, I’m not going to bother you about it. Additionally, if you decide to go this route, be sure that you understand we are not responsible for any damage to your, your device, or anything else caused by you or use of this software in a way that is not congruent with the expected use of the software (which is inherently broken by trying to cheat the system).
Severability
Whenever possible, each provision of this Agreement, will be interpreted in such manner as to be effective and valid under applicable law, but if any provision of this Agreement is held to be invalid, illegal, or unenforceable in any respect under any applicable law or rule in any jurisdiction, such invalidity, illegality, or unenforceability will not affect any other provision or any other jurisdiction, but this Agreement will be reformed, construed, and enforced in such jurisdiction as if such invalid, illegal, or unenforceable provisions had never been contained herein.
Entire Agreement
This Agreement constitutes the final, complete, and exclusive statement of the agreement of the Parties with respect to the subject matter hereof, and supersedes any and all other prior and contemporaneous agreements and understandings, both written and oral, between the Parties.
